Terms of Service
The rules of the house, in plain language
Effective October 23, 2026. Gather And Study is built for real in-person study groups. These terms keep the free tier fair for individuals and clear for organizations.
1. Who these terms cover
These Terms of Service (“Terms”) are a binding agreement between you and Gather And Study (“Gather And Study”, “we”, “us”) governing your access to and use of gatherandstudy.com and the Gather And Study web application (the “Service”). By creating an account, signing in, or using the Service, you agree to these Terms and our Privacy commitments (/privacy). You must be at least 16 years old (or the age of digital consent in your jurisdiction) to create an account.
2. The Free tier and organizational anti-circumvention
The Free account tier allows an individual to lead up to 4 active groups at a time and to belong to any number of groups as a member. A Free group of any kind, including classrooms, Vacation Bible School and camps, holds up to 20 members. A member is a person with an account in the group, such as a member, leader, parent or guardian, volunteer or staff member; children registered by a parent for an event are not counted as members, and the event’s own registration capacity still applies to them. When a group reaches 20 members it cannot take new members on the Free tier, while members already in it keep their place. Groups covered by an Organization plan (such as a school and the classrooms linked to it) follow that plan’s limits instead. Closed or inactive groups stay readable and do not count toward the 4 active groups. The Free tier is strictly for independent, self-organized groups of individuals. Schools, universities, companies, churches, homeschool umbrellas, clubs, nonprofits, and other organizations may not direct, coordinate, instruct, or encourage their staff, faculty, employees, leaders, or volunteers to register or run organization-affiliated groups across separate Free accounts in order to bypass or substitute for an Organization plan. We reserve the right to consolidate accounts, pause or close groups, suspend access, or require a paid Organization subscription where we determine that multiple groups or accounts are being coordinated by, promoted by, or operated on behalf of an organization.
3. Voluntary supporter contributions and paid plans
We aim to keep Gather And Study free for independent groups. If you choose to make a one-time or recurring supporter contribution (donation or tip) to support the Service, you acknowledge that supporter contributions are voluntary payments for the continued operation of the Service, are not charitable tax-deductible donations, do not grant ownership or special legal rights, and are non-refundable except where required by applicable law. You may cancel a recurring supporter contribution at any time before its next billing date. Paid group or Organization subscriptions, when offered, are billed according to the pricing and terms presented at checkout.
4. Your content and study materials
You retain ownership of the plans, notes, messages, files, photos, and other material you post or upload to your groups (“User Content”). Gather And Study does not sell, license, or publish study material. By posting User Content, you grant Gather And Study a limited, non-exclusive, royalty-free license solely to store, process, back up, and display that content to you and the members of your group in order to operate the Service. You represent that you have the necessary rights to share anything you upload and that your User Content does not infringe the copyright, privacy, or other rights of any third party.
5. Acceptable use and group privacy
You agree not to use the Service to violate any law; harass, threaten, or impersonate others; send unsolicited bulk messages or spam; upload malware or malicious code; scrape, crawl, or probe the Service or its directory; or share another member’s meeting address, contact details, or family photos outside the group without their permission. Group leaders are responsible for managing membership and join requests for their own groups.
6. Closing a group, deleting your account, and suspension
A group leader may close a group at any time from the group’s settings page, leaving its past plans and board readable without counting toward the 4 active groups its leaders can lead. You may leave a group or permanently delete your account and all content associated with your name at any time from your profile page (/app/me). Gather And Study may pause, suspend, unlist, or terminate any account or group that violates these Terms — including the organizational anti-circumvention rule in Section 2 — or that poses a security, legal, or operational risk to the Service or its users.
7. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. GATHER AND STUDY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR PERMANENTLY AVAILABLE, AND YOU ARE ENCOURAGED TO KEEP YOUR OWN COPIES OF IMPORTANT STUDY NOTES OR FILES.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL GATHER AND STUDY OR ITS FOUNDERS, OPERATORS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, GOODWILL, OR PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR ANY IN-PERSON MEETING ORGANIZED THROUGH IT. OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO GATHER AND STUDY IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) FIFTY U.S. DOLLARS ($50.00).
9. Governing law, disputes, and updates
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising under or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in California, and you consent to personal jurisdiction in those courts. We may update these Terms as the Service grows; when we make material changes, we will update the effective date on this page and notify active account holders.
